Abstract: The author explored the legal principle basis of patients' informed consent and considered the origin of patients' informed consent is on the basis of the special relationship between doctors and patients and the protection of the right of consumers and the respect of patients personality.Patients' informed consent is patients' foundational right and medical institutions' obligation.The establishment of right and obligation enhances the communication between doctors and patients and reduce the possibility of the medical disputes.
